Demolition of resort gate in Panglao paused pending court decision

PANGLAO, Bohol — The planned demolition of a resort gate, guardhouse, and fence in Barangay Bolod, Panglao, was put on hold Friday, March 13, after the resort owner asked the court for clarification on which portions of the road must be cleared.

Dr. Doloreich Dumaluan, owner of Marilou Resort (formerly Dumaluan Beach Resort II), requested the court to specify the exact width and extent of the barangay road that must be cleared before any demolition could proceed.

The scheduled demolition was in enforcement of a Writ of Mandamus issued under Special Civil Action No. 10425.

Bohol Provincial Legal Officer Handel Lagunay and Panglao Mayor Edgardo Arcay went to the resort to implement the court order, which stems from a complaint filed by Jacques Chaoulli seeking the removal of obstructions along the road leading to the beach.

The court decision, dated Nov. 11, 2025, and already final and executory, directs the respondents to clear the barangay road of any obstruction. Separately, the Ombudsman also instructed Arcay to ensure that all public road entrances in Panglao remain open and accessible.

Dumaluan said the resort management is willing to voluntarily dismantle the gate and fence if the court confirms they encroach on the barangay road.

He assured authorities that the case will no longer be elevated to a higher court once the clarification is issued.

Operating the resort since 1993, residents and local fishermen have consistently been able to access the shoreline and have not been barred from the beach.

Lagunay said the demolition team, along with personnel from the Bohol Provincial Police Office and the Panglao municipal government, withdrew from the site while awaiting the court’s official clarification.
